I want to share with you some thoughts on the practice of law, and on what to look for in a lawyer. These thoughts are based upon my 35 years' experience as a lawyer.
Law is an art, rather than an exact science. The situation of each of my clients is unique. Many factors must be considered in predicting the best course of action for each person. A great deal of judgment is involved. There are good reasons why attorneys are sometimes referred to as counselors.
A good lawyer must have "people skills". He must know how to relate to his client and others. He must have integrity, be well prepared, and be loyal to his client. He must have common sense. He must be able to anticipate future events. He must be able to think quickly on his feet. He must know how to advocate his client's cause before judge and jury.
Computerization has had a significant effect on the law, as it has on all of society. However, I feel that the human factors described above are still the most important ingredients in the making of a good lawyer.
One other thought regarding developments in the law. I am very concernced about the so-called "tort reform" movement. It involves passing laws limiting the amount a person injured throught the carelessness of a medical provider or large company can recover. The primary promoters of such law are insurance companies, yet there is little evidence that insurance costs go down in places where such laws are passed. Why should special interests be protected from their careless acts, while individuals and small businesses are not? I hope that you will share my concern.
